Operator: Thanat Theerabootwongkul trading as TaleOak
ABN: 16 232 595 236
Business name: TaleOak (a business name is not a separate company)
Contact: founder@taleoak.com
Website: https://www.taleoak.com

These Terms are the rules for using TaleOak (the app, website and related emails). By creating an account, accepting an invite or using TaleOak, you agree to these Terms and our Privacy Policy at https://www.taleoak.com/privacy.

1. Who we are

These Terms are with Thanat Theerabootwongkul trading as TaleOak (ABN 16 232 595 236), a sole trader in Australia. "TaleOak", "we", "us" and "our" mean that operator. The business name "TaleOak" is not a separate company. "You" means the person using TaleOak.

2. What TaleOak is

TaleOak is a private stories app for families. Once a week you draw a question card, ask Mum or Dad in person or on a call, and save what they tell you to your private family house.

TaleOak may include Today, Draw a tale, Stories and chapters (including one voice clip on a chapter), Keeps, the Tree and house seats, Talk, Mum's page and Dad's page, Visits, a house switch, invites by email, Share, the blog and the FAQ, and other features we add over time. Features may change. New or early features may be less stable.

TaleOak is not a clinic, not a health record and not a marketing list.

3. Who can use TaleOak

  • You must be 15 or older to create your own TaleOak account, and able to make a binding agreement where you live.
  • If you are under 15, you may only join after a parent or guardian confirms and agrees. We email them a confirm step. A parent or guardian may also add a kids or house seat they control.
  • We do not create an independent account for anyone under 15 without that parent or guardian confirm.
  • You must give your real date of birth and accurate details when you sign up.
  • You must agree to these Terms and the Privacy Policy before an account is created, and before a seat is created from an invite.

4. Your account

  • One person per account. Don't share your password.
  • Keep your login secure. You are responsible for what happens under your account.
  • If you sign up with email and password, confirm your email when we ask. Until you do, some features (like inviting others) may not work.
  • Tell us at founder@taleoak.com straight away if you think someone has used your account.

5. Houses, seats and invites

  • A family house is a private space. People with a seat in a house can see the stories, photos, Keeps, draws, Talk, visits, appointment plans and Mum's and Dad's pages shared there. They can also see each member's name, photo and full date of birth. They can't see houses they weren't invited to.
  • Only invite people you have a fair reason to invite.
  • When you invite someone, we send the invite email for you. It's only about the invite, not marketing.
  • Before they accept, they see who invited them, the kind of seat, and what the seat can see.
  • They must agree to these Terms and the Privacy Policy before the seat is created. They can say no or ignore the invite.
  • Don't email a child's own inbox for sign-up. Don't use invites to spam or harass anyone.

6. Saving stories about Mum, Dad and others

  • Ask first. The adult who plants Mum or Dad, or who saves a story, voice clip, photo or note about anyone, must have a fair reason. Where that person can decide, the adult must also have that person's okay before saving it.
  • Let them know. If you add someone who has no account, tell them TaleOak holds information about them and that they can contact founder@taleoak.com.
  • If Mum or Dad can't decide for themselves, only a family member who already helps them day to day may add what the family should know, and only inside that house.
  • Their stories, not ours. TaleOak does not own those stories. The person written about can ask founder@taleoak.com for access, correction or deletion, even with no account. We will check the request is genuine and act where we can.
  • Copies other seats hold. Deleting one person's account does not always remove content that other seats in the house still hold. If a family asks, we will help them sort out what stays in the house and what gets deleted.
  • Health details. TaleOak doesn't ask for health details. Please leave them out, and don't upload hospital files, Medicare numbers or clinical notes.

7. Your content

You keep ownership of what you add. You give us a worldwide, non-exclusive, free licence to host, store, copy, display and process it only to run TaleOak for you and the seats in your house (including security and keeping the service working). This licence ends when the content is deleted from TaleOak, except for copies other seats still hold.

Only add content you have the right to share. TaleOak has no export, so keep your own copies of anything that matters to you. We do not promise that content will never be lost.

The app doesn't yet have delete buttons for stories, photos, Talk, visits or accounts. To have something deleted, or to get a copy of your personal information, email founder@taleoak.com.

If you use Share to send a Keep outside TaleOak, the image is made on your device and you choose where it goes. Once it leaves, we can't control or delete it.

8. Voice clips

You can save one voice clip with each chapter, up to 5 minutes long. Before you record, you must have the okay of everyone who will be heard in it: to record them, to save the clip in your family house, and to let people with a seat in that house play it. Don't record anyone in secret, and don't record anyone who can't decide for themselves. Recording laws differ between states and territories, and you're responsible for following the ones that apply to you.

Your clips stay yours. You let us store them and play them to people with a seat in your house, only so TaleOak works. The person who recorded a clip can delete it at any time. Deleting a clip keeps the chapter's story and photos. We may remove a clip if someone heard in it asks us to.

9. Mum's page and Dad's page

Mum's and Dad's pages hold what you've learned about them, like their likes and dislikes. They are not medical advice and not a clinical record. You are responsible for how you use what you save there.

10. Using TaleOak fairly

You agree not to:

  • break the law or anyone else's rights, including privacy and copyright
  • save anything about someone without a fair reason, or against their wishes where they can decide
  • harass, threaten or embarrass anyone through TaleOak
  • get into a house you don't have a seat in, or create fake seats to trick anyone
  • scrape, attack, overload or reverse engineer TaleOak, except where the law allows
  • upload malware
  • use TaleOak as a clinic, school records system or government filing system
  • send marketing through our invite tools

We may remove content or seats that break these rules.

11. Outside organisations

TaleOak is a family product. It is not a clinic, not a school records system, and not a clinical or health record. We will not let any outside organisation, such as a health or support provider, onto TaleOak or into a family house until there is a written data-processing agreement, a named subprocessor list, and a stated storage location. No such agreement exists today. Family content is not sold and is not used to train AI models.

12. Other services we rely on

TaleOak relies on other companies for hosting, the database, email and sign-in with Google or X. Their terms also apply when you use those features. They are listed in the Privacy Policy. We are not responsible for their outages beyond our reasonable control.

13. Price

TaleOak is free for now. We may add paid plans later. If we do, we will explain prices and renewals clearly before you pay, and you won't be charged unless you choose a paid plan.

14. Our name and software

TaleOak's name, branding, software and design belong to us (or our licensors). You may not copy them or use our brand without permission, except to use TaleOak normally.

15. Privacy

Our Privacy Policy forms part of your agreement with us. It explains how we handle personal information, including for people in stories without an account.

16. Disclaimers

To the fullest extent the law allows, TaleOak is provided "as is" and "as available". We do not promise uninterrupted or error-free service, or that content will never be lost.

Australian Consumer Law (and similar laws elsewhere) may give you guarantees we cannot exclude. In those places, our disclaimers apply only as far as the law permits.

17. Liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential loss, or loss of profits or opportunity, arising from your use of TaleOak. We are not liable for loss of data either, unless it was caused by our negligence or by our breach of these Terms or the Privacy Act.

Where we are liable and the law allows a limit, our total liability for a claim is limited to AUD $100 or the amount you paid us in the 12 months before the claim, whichever is higher.

That cap does not apply to non-excludable consumer guarantees under Australian Consumer Law, or to loss caused by a breach we were legally required to prevent. Nothing in these Terms excludes liability that cannot be excluded by law.

18. Ending the agreement

You can stop using TaleOak at any time and ask us to close your account by emailing founder@taleoak.com. What happens to your information is set out in the Privacy Policy, including content other seats still hold.

We may suspend or close an account or seat if you break these Terms, or if we must for legal or safety reasons. We will try to give reasonable notice when we can. If we decide to close TaleOak, we will email you at least 30 days before, unless something outside our control stops us. During that time, you can ask founder@taleoak.com for a copy of your personal information.

19. Disputes

If something goes wrong, email founder@taleoak.com first. We will try to sort it out with you in good faith. This does not stop you from contacting a consumer protection body or the Office of the Australian Information Commissioner (OAIC).

20. Changes to these Terms

We may update these Terms. We will change the dates at the top. For important changes, we will tell you in the app or by email before they apply, and ask you to agree again the next time you open TaleOak. If you don't agree, you can stop using TaleOak and ask us to close your account.

21. Notices

We may send notices by email to the address on your account, or in the app. You can contact us at founder@taleoak.com.

22. General

If a court finds part of these Terms unenforceable, the rest still applies. These Terms, together with the Privacy Policy and any paid-plan terms we show you before you buy, are the whole agreement between you and us about TaleOak. If we're slow to use a right under these Terms, we haven't given it up.

23. Governing law

These Terms are governed by the laws of Queensland, Australia. Courts in Queensland may hear disputes, without stopping you from relying on mandatory consumer protections where you live.
